Service Level Agreement for Windows Platform, for the process of online backup and restores. It does not include Sharing.
Pro Softnet Corporation ("PSFT") agrees to provide the Customer ("You") the IBackup® Online Backup Service (the "IBackup Service") for Your Data for Your initial server and any subsequent servers you may choose to enroll (each, a "Protected Server"), as described in this Service Level Agreement (the "SLA" or "Service Level Agreement"). For purposes of this Agreement "Your Data" shall be deemed to include any information transmitted from your Protected Servers to the IBackup Service. The most likely application is IBackup for Windows ("IBackup agent") for executing your backups and restores.
The IBackup Service is warranted to substantially conform to the service levels specified below for any Protected Server, after the Initial Backup has taken place on such Protected Server.
Backup configurations can be set to run periodically, typically on a daily scheduled basis. When a backup configuration is running, only changes to files and databases you have selected for backup on the Protected Server are captured by the IBackup agent and immediately queued for transmission to the IBackup Servers. It is critical that the protected server have a stable Internet connection to facilitate the necessary data transfer for successful backups. User is expected to review the log content of every backup execution to make sure that the backups have taken place successfully. IBackup agent provides various means for communication of the backup status including desktop notification, email notification with various information level options.
After the initial backup of a Protected Server is completed, Your data on such Protected Server is archived to another storage device at least once a day, using 'Snapshots' Technology. Currently, the number of such Snapshots is fixed at 10. In other words, a user will be able to access and restore from any of the previous 10 daily Snapshots. The Snapshot count may change without notice.
Restore time over the network is limited by Your connection bandwidth speed and quality up to speeds of approximately 1.5 Mbps. At speeds faster than 1.5 Mbps, other factors may limit network restore times including network performance, data compressibility and end user systems. Restore from Snapshots may be slower than the restores from most recent data, due to inherent differences in the media speed.
When used in accordance with the usage requirements and guidelines specified in the product documentation of IBackup agent, the IBackup Service provides online backup protection for the operating systems listed. The IBackup Service is able to protect server data information subject to limitations outlined for respective applications.
To deploy the IBackup Service, just download a software module (the “IBackup Agent”) from a designated web site on to each Protected Server and Install the agent. Once configured and deployed, the IBackup Agent replicates and synchronizes the selected data in its entirety (the “Initial Backup”) to one of the offsite data storage backup vaults containing servers (the “IBackup Server”). After the initial Backup, only changes to files and databases selected for backup on the Protected Server (the “Changes”) are sent to the IBackup Server.
You manage the IBackup Service through a client interface that is personalized with
Your custom content.
From time-to-time this Service Level Agreement may change. A modification may include, but is not limited to, changes in system requirements, restrictions, limitations, or bandwidth requirements. You will be notified via electronic mail and/or through a Web site posting, whose location will be specified in the electronic mail notification. You are responsible for ensuring that Your system conforms to any updated restrictions, limitations or requirements.
In the event that Your use of the IBackup Service is adversely affecting the operation of the IBackup Service, Your IBackup Service may be terminated by PSFT without liability to PSFT, its suppliers or other end users. To prevent Your use of the IBackup Service from adversely affecting the effectiveness of the IBackup Service for other end users or to preserve system integrity and prevent network abuse, a notice shall be issued to You promptly via email, following such emergency termination. You are responsible for updating PSFT of any changes to Your email and contact information to facilitate communication of these notices, via a change to your 'Profile' information, using the web interface.
PSFT assurances You that at least via one of its access methods, which may include IBackup agent and the Web Interface, its online backup service is accessible at least 99.9% of the time, at its data center. This does not provide assurance on the actual backup and restore execution since that is dependent on various factors, including network connectivity at user end and the route from the user's computer to IBackup servers, on which PSFT has little control. In the event the service is not available at the data center for times that exceed the limits mentioned above when computed on a yearly basis from a point in time, the liability would be limited to the use's prorated charges for the outage time. |
